Česká politologie v mezinárodním srovnání

V návaznosti na předchozí posty ještě k výsledkům české politologie dle jednoho výzkumu.

Z výsledků je zřejmě, že počet českých politologických publikací dosahuje stanoveného mezinárodního průměru. Například oproti Slovensku, Maďarsku, Polsku a Slovinsku je Čechy v časopisech zařazených do databáze WoS publikováno MNOHEM více politologických článků. 

Co se týče kvality časopisů, ve kterých se publikuje, tak se u českých publikací jedná ve velké většině o časopisy z poslední (kvalitativně) čtvrtiny v rámci "political science" v databázi WoS. To ale samozřejmě neznamená, že se jedná o špatné časopisy. Jenom to, že u ostatních zemí je poměr mezi publikacemi v kvalitnějších a méně kvalitních časopisech více vyrovnaná.

České IR v mezinárodním srovnání

Jak jsem psal zde, think-tank IDEA při CERGE-EI a AV ČR zveřejnil výsledky výzkumu ohledně výkonu české vědy v mezinárodním srovnání. Analýza posuzuje publikační výkon českých vědců v období let 2010 až 2014, a to pomocí kvantitativního hlediska (počet článků) a kvalitativního hlediska (kvalita časopisů, kde se články objeví). Česká věda je porovnávána s jedenácti vybranými zeměmi, a také vůči průměru jejich publikačních výsledků. Tento průměr jedenácti zemí tak stanovuje jakýsi mezinárodní standard, se kterým je ČR srovnávána. Srovnání probíhá v rámci poměrně úzce definovaných disciplín, a to jak v přírodních vědách, tak i ve společenských vědách, tedy včetně mezinárodních vztahů a politologie.

Fisher v. University of Texas - pozitivní diskriminace

V prosinci proběhlo ústní jednání před Nejvyšším soudem USA ve věci pozitivní rasové diskriminace u příjmaček na University of Texas. O případu jsem na JP psal zde. Co se na First Street stalo? Zástupci univerzity trochu posunuli svou argumentaci, Scalia vyvolal drobný skandál, soudkyně Ginsburg do věci rýpala hlouběji, soudkyně Kagan se opět neobjevila a není jasné, jak moc soud do afirmativní akce zasáhne.

Česká právní věda v mezinárodním srovnání

Think-tank IDEA při CERGE-EI a AV ČR zveřejnil výsledky výzkumu ohledně výkonu české vědy v mezinárodním srovnání. Zde jsou výsledky v novinovém článku. Analýza posuzuje publikační výkon českých vědců v období let 2010 až 2014, a to pomocí kvantitativního hlediska (počet článků) a kvalitativního hlediska (kvalita časopisů, kde se články objeví). Česká věda je porovnávána s jedenácti vybranými zeměmi, a také vůči průměru jejich publikačních výsledků. Tento průměr jedenácti zemí tak stanovuje jakýsi mezinárodní standard, se kterým je ČR srovnávána. Srovnání probíhá v rámci poměrně úzce definovaných disciplín, a to jak v přírodních vědách, tak i ve společenských vědách.

Obecně z výsledků vyplývá, že česká věda dosahuje určeného průměru nebo jej překonává pouze v některých disciplínách přírodních věd a inženýrství/technologie. Společenské vědy jsou hluboko pod průměrem, a to včetně práva.

It’s 1944 in the Arab world: Defeating the jihadists demands the creation of a healthy Sunni body politic.

What would a revived Sunni heartland in Iraq and Syria look like? Well, you can get a pretty good idea by examining Iraqi Kurdistan. It flowered under a U.S. no-fly zone known as “ Operation Provide Comfort” that started in 1991. Under this protective cover, investment, security and political stability came together in a virtuous cycle.

When we think about the future of Iraq and Syria, we should have in mind vibrant Sunni provinces that, like Kurdistan, are part of a loose federal state. In building a strategy for defeating the Islamic State, creating this “Sunnistan” will be the long pole in the tent.

Mapa české vědy

CERGE-EI IDEA zveřejní 1. prosince výsledky výzkumu výkonu české vědy. Část výsledků vyšla v sobotních Lidových novinách. Pokud to chápu správně, výzkumníci vybrali řadu zemí (Estonsko, Maďarsko, Polsko, Slovinsko, Slovinsko, Rakousko, Finsko, Izrael, Nizozemsko, ...), ze kterých vytvořili průměr, co se týče kvantity a kvality vědeckých publikací. Ze skupiny těchto zemí tedy získali průměrnou hodnotu, kterou následně použili ke srovnání s ČR. Na jedné ose výsledného grafu je tak počet článků v dané disciplíně a na druhé ose kvalita výstupů. Následně do tohoto výsledného grafu zařadili výsledky jednotlivých českých vědeckých disciplín a sledovali, kam se jednotlivé zápisy umístí - tedy zda výš od průměru (více kvalitní) nebo víc doprava (víc výstupů), a nebo naopak. 

Velká většina české vědecké produkce se pohybuje níž a vlevo. Výjimky jsou některé obory přírodních věd a inženýrství/technologie. Nejlépe ze společenských věd je na tom ohledně kvantity politologie, která je sice kvalitativně nízko (90 % pod průměrem), ale kvantitativně je přesně na průměru. Co se týče kvality, tak jsou nejlepší mezinárodní vtzahy, které jsou nejblíž kvalitativního průměru ve srovnání s ostatními společenskými vědami.



Výsledky samozřejmě nelze přeceňovat. Každý výsledek bude zřejmě nutné doplnit kvalitativním pohledem, aby se ukázaly některé speciality jednotlivých oborů atd. Výzkum se ale tváří jako jeden z nejvěrohodnějších celkových pohledů na českou vědu. Pro mě bude zajímavé se podívat, konkrétně jaké země byly vybrány pro sestavení onoho průměru a podle jakého klíče (to je opravdu zásadní). Pak jsem zvědav na právo. To bude asi dost dole.

Iran Deal Is Not ‘Legally Binding’ and Iran Didn’t Sign It

Dohoda velmocí s Íránem ohledně jeho jaderného programu, tedy The Joint Comprehensive Plan of Action, není mezinárodní dohoda, ani tzv. executive agreement, a Írán ji ani nepodepsal.
“The Joint Comprehensive Plan of Action (JCPOA) is not a treaty or an executive agreement, and is not a signed document,” wrote Julia Frifield, the State Department assistant secretary for legislative affairs, in the November 19 letter.

John Bolton: To Defeat ISIS, Create a Sunni State

Today’s reality is that Iraq and Syria as we have known them are gone. The Islamic State has carved out a new entity from the post-Ottoman Empire settlement, mobilizing Sunni opposition to the regime of President Bashar al-Assad and the Iran-dominated government of Iraq. Also emerging, after years of effort, is a de facto independent Kurdistan.

If, in this context, defeating the Islamic State means restoring to power Mr. Assad in Syria and Iran’s puppets in Iraq, that outcome is neither feasible nor desirable. Rather than striving to recreate the post-World War I map, Washington should recognize the new geopolitics. The best alternative to the Islamic State in northeastern Syria and western Iraq is a new, independent Sunni state.

  • Pan soudce to tedy nebude mít jednoduché: Judge to Rule on Police Shooting Video that ‘Might Rip Chicago Apart’ ("A judge is set to decide this week whether to make public a video showing Chicago police shooting a black teenager 16 times, footage that those who have seen it say could create the kind of unrest seen in other U.S. cities following police-related deaths.")
  • Češi budou Maďary milovat! Hungary to challenge refugee quotas in EU court ("The bill, approved by 154 votes in favor from the ruling Fidesz party, and the opposition far-right Jobbik, with 41 against, states that the quota ignores the European principle of subsidiarity and fails to grant national parliaments the opportunity to express their opinion. (..) The preamble of the bill passed on Tuesday also says the quota system is dangerous, would increase crime, spread terror and endanger Hungarian culture.")

  • Kosovo's Constitutional Court has suspended an agreement with Serbia negotiated with the support of the EU. ("The decision of Kosovo's Constitutional Court to review an agreement to normalize economic and cultural relations between Serbia and Kosovo came only one day after Kosovo's failed attempt to join UNESCO. With help from Russia, Serbia had set all diplomatic means in motion to prevent Kosovo's membership in the UN's cultural organization, which Kosovo's Prime Minister Isa Mustafa called a "racist campaign. (..) Kosovo's Prime Minister Mustafa and Serbian Prime Minister Aleksandar Vucic agreed to establish an association of nine municipalities in Kosovo mostly inhabited by Serbs. Soudní novinky 15-46 (Anti-semitismus není sranda)

Nyní již způsobně:

  • Colombia's Gay Adoption Ruling ("In a 6-to-2 decision, the Constitutional Court found that barring gay people from adopting had unreasonably deprived children of the right to be raised by families. (..) The judges argued that there was no evidence that same-sex couples were unfit parents (..).")
  • Štrasburk natřel antisemitského komika hned z voleje: Dieudonné’s show “as dangerous as a head-on and sudden attack” ("They ruled that human rights law does not protect negationist and anti-Semitic performances. In its decision in the case of M’Bala M’Bala v. France (application no. 25239/13) the European Court of Human Rights declared the application inadmissible by a majority. The decision is final.")
  • Projev Josefa Baxy na Výročním sněmu Soudcovské unie (atmosféra mezi vrcholnými soudci a MSpr by se asi dala krájet).
  • ECB Faces Three Suits Over Quantitative Easing in Germany ("German politicians who failed in previous attempts to have courts derail European Union policy filed lawsuits at the country’s top court challenging the European Central Bank’s 1.1 trillion-euro ($1.2 trillion) asset-purchase program. Three suits were filed over the last six months, according to Michael Allmendinger, a spokesman for the Federal Constitutional Court in Karlsruhe. (..) The cases are separate from a complaint attacking the ECB’s 2012 Outright Monetary Transactions program. That action was dealt a setback when the EU’s highest tribunal in June largely approved the OMT. The German judges still have to make a final ruling in that litigation.")
  • "The Supreme Court announced Friday it would hear a major abortion rights case next year, the most significant abortion case heard by the court since 1992.   • "Vlastník může odmítnout pronajmout byt cizincům nebo Romům. Makléři by za to hrozil soud" ("Realitním makléřům by se v budoucnu mohla jejich práce zkomplikovat. Když jim vlastník nemovitosti zadá, že ve svém nájemním bytě nechce určitou skupinu lidí, například cizince, invalidy nebo Romy, nebudou moct jeho přání vyhovět. Pokud to udělají, skončí pravděpodobně před soudem. Průlomové rozhodnutí pro takové případy vydal litoměřický soudce Jiří Šlapal. Ten řešil kauzu Lenky Balogové, které realitní kancelář Elišky Noskové nechtěla poskytnout pronájem bytu v Lovosicích, protože je Romka. Makléř přitom plnil výslovné přání majitele této nemovitosti. Jenže Šlapal v písemném rozsudku, který před několika dny dokončil, uvedl, že takový postup není možný. "Realitní makléř nemůže takový diskriminační pokyn ze strany vlastníka přijmout a považovat jej za závazný," napsal soudce.")

Soudní novinky 15-44+45 (O gruzínských kšeftech s marihuanou)

Semestr je hektický, proto opět dvoutýdenní shrnutí.

  • Dlouhý a otevřený rozhovor v HN s předsedy NSS a NS Baxou a Šámalem zejména o radě soudnictví a zjevně napjatých vztazích s ministerstvem spravedlnosti.
  • Ulad Belavusau komentuje rozsudek ESLP v případu Perincek proti Švýcarsku. ("In combination with an extremely questionable hierarchy between the Holocaust and other genocides, this failure to distance from Perinçek – albeit rightly protecting his freedom of expression – leaves strikingly little to sustain the dignity of the Armenian victims.")
  • Ibtissem Guenfoud: Boycott calls and double standards: another French limitation of freedom of expression ("France, once the motherland of human rights, is increasingly clamping down on freedom of expression. According to a recent decision by the French Supreme Court, calling for boycott on Israeli goods is illegal under french law. Fourteen members of the activist group Boycott, Divestment & Sanctions (BDS), campaigning for the economic, academic, sports and cultural boycott of Israel, learned it the hard way in two decisions of October 20th which confirmed on the highest level of criminal jurisdiction their conviction to 12,000 € in damages and 1,000 € in fine. Joining Israel, France makes for the only european country to penalize boycott calls on products of Israeli origin, as well as the first democracy.").
  • Sanjeevi Seshadri: David V. Goliath – The Republic of Marshall Islands’ Day in Court ("The Republic of Marshall Islands (‘RMI’) is an island nation, located in the Pacific Ocean, with a population of 68,840 people. On the 24th April 2014, the RMI filed a dispute before the International Court of Justice (‘ICJ’), against 9 states, namely, the United States, United Kingdom, France, Russia, China, India, Pakistan, Israel, and North Korea for violating their nuclear disarmament obligations under customary international law and the Treaty on the Non-Proliferation of Nuclear Weapons (‘NPT’).")
  • A man from Northern Ireland has won a landmark case in the European Court of Human Rights. The claimant, known only as RE after being granted anonymity by the court, alleged that the PSNI breached his right to privacy by listening to conversations he had with his lawyer.
  • The Constitutional Court of Armenia on Tuesday ruled that journalists are not obliged to disclose their confidential sources of information in cases not involving heavy crimes and the need to protect a person.
  • The Georgian Constitutional Court ruled on Saturday that applying imprisonment as a punishment for purchasing and possessing up to 70 grams of marijuana for personal use is unconstitutional. (Ilustrační foto z Gruzie, nejedná se o marihuanu.)

Konec pozitivní rasové diskriminace na americkych univerzitach?

V letošním roce bude Nejvyšší soud USA opět posuzovat otázku pozitivní rasové diskriminace u přijímaček na americké univerzity. Už skoro 40 let v USA v podstatě platí, že používat rasu jako faktor při hodnocení studentů hlásících se na univerzity je možné, ale za poměrně striktních podmínek. V roce 2003 SCOTUS do jisté míry uvolnil posuzování pozitivní diskriminace na vysokých školách, když liberální většina rozhodla, že univerzitám lze přiznat jistou volnost při stanovování mechanismu hodnocení rasy jako faktoru u přijímaček. V roce 2013 naopak tuto volnost konzervativní většina omezila a stejný případ se po krátkém intermezzu u texaských soudů dostal před SCOTUS znovu. Je možné očekávat, že až soud případ Fischer II posoudí, dojde k dalšímu omezení praxe zvýhodňování některých rasových a etnických menšin.

  • Pár nových neliberálních rozhodnutí malajského federálního soudu (zákaz protiislámských knih, transgender problematika, svoboda shromažďování a projevu). 
  • "Families of three Bosnian Muslims who were killed after leaving UN protection in Srebrenica in 1995 asked the European Court of Human Rights to prosecute three ex-UN commanders, AFP reported. A Dutch appeals court ruled in April that Battalion commander Thom Karremans and two other officers should not be prosecuted."
  • A možná se ve Štrasburku potkají i s neblahé paměti Viktorem Janukovyčem.
  • A do třetice z ESLP: "The European court of human rights (ECHR) has ruled that a Turkish politician should not have been prosecuted for denying that the mass killing of Armenians by Ottoman Turkey in 1915 was a genocide." Velká věc! Arménská genocida se dle soudců zásadně liší od holokaustu. "The ECHR said it did not have the authority to rule on whether the Armenian killings were a genocide or not, which was a job for international criminal courts. (..) But it ruled that in the specific circumstances of the case, a democratic society should not have gone as far as prosecuting Perincek over his comments. “The context in which they were made had not been marked by heightened tensions or special historical overtones in Switzerland,” the ruling said. “The Swiss courts appeared to have censured Mr Perinçek simply for voicing an opinion that diverged from the established ones in Switzerland,” it added." Na fotce můžete vidět ruiny prastarého arménského města Ani na severovýchodě Turecka - na informačních tabulích se slovo "arménský" takřka nevyskytuje... 
  • First the Netherlands, now Pakistan’s high court comes to defence of climate: "The high court of justice in Lahore has ordered the creation of a “climate council” to force the Pakistani state to uphold its environmental commitments. A farmer went to the court with the charge that his “fundamental rights” had been breached by the lack of action on the part of Pakistan’s climate change minister. Pakistan has been hit by three consecutive years of deadly floods. (..)   • Velká indická frajeřina na více než 1000 stran: "Declaring that the judiciary cannot risk being caught in a “web of indebtedness” towards the government, the Supreme Court on Friday rejected the National Judicial Appointments Commission (NJAC) Act and the 99th Constitutional Amendment which sought to give politicians and civil society a final say in the appointment of judges to the highest courts. “It is difficult to hold that the wisdom of appointment of judges can be shared with the political-executive. In India, the organic development of civil society, has not as yet sufficiently evolved. The expectation from the judiciary, to safeguard the rights of the citizens of this country, can only be ensured, by keeping it absolutely insulated and independent, from the other organs of governance,” Justice J.S. Khehar, the presiding judge on the five-judge Constitution Bench, explained in his individual judgment. (..) Pozitivní rasová diskriminace na amerických univerzitách

V současnosti je v USA možné pozitivně diskriminovat na základě rasy u příjmaček na univezity jen za účelem dosažení cíle univerzity ve smyslu rozmanitosti studentů. Jen to je soudci Nejvyššího soudu USA již od 70. let považováno za důvod, kterým je možné narušit princip barvoslepé rovnosti občanů. K tomuto principu se SCOTUS letos znovu vyjádří, když bude podruhé posuzovat věc Fischer. Jak jsem na PM psal, proti tomuto argumentu nicméně existuje řada studií, které v rámci tzv. "mismatch efektu" ukazují, že i samotné menšiny, kterým má pozitivní diskriminace pomáhat, nakonec skončí s horším výsledkem v podobě menší úspěšnosti na obtížných vysokoškolských oborech, na které by se pozitivně diskriminovaní studenti jinak nedostali, a na kterých nakonec často ani neuspějí.

Jiným možným ospravedlněním pozitivní diskriminace by mohl být, a v jiných oblastech také z právního pohledu bývá, princip odčinění dřívějších křivd, kterých se bílá většina na menšinách dopustila. To sice v současnosti v oblasti přijímaček na univerzity ústavněprávně možné není, ale i tak existují zajímavé argumenty, které tímto principem nutnost pozitivní diskriminace zdůvodňují.

Jedním z proponentů tohoto argumentu je Richard Rothstein z Economic Policy Institute ve Washingtonu DC, který k tomu nedávno napsal moc zajímavý článek podpořený daty. Jádro argumentu zní v podstatě tak, že ve 20. století byly oficiální politiky státu rasově diskriminační vůči černochům, a to v oblasti podpory bydlení. Díky tomu bílá střední třída získala nemovitostní majetek, který jí pomohl na celé dekády dobudoucna, zatímco černá menšina k této pomoci státu přístup neměla. Je tedy opět na státu, aby se tyto konkrétní výhody, které v rámci rasové diskriminace ve 20. století přiznal pouze bělochům, pokusil černé menšině dodatečně odčinit a nahradit.

From the 1930s through the 1950s, the Federal Housing Administration guaranteed production loans to developers for construction of suburban subdivisions, on explicit condition that these projects be barred to otherwise-qualified black families. Nationwide, federal mortgage guarantees subsidized working- and lower-middle-class white families (many headed by returned war veterans) to flee urban neighborhoods for suburban communities whose racial exclusivity was government-enforced. Black veterans and other working families were openly denied such support, not only by prejudiced real estate agents, but by racially explicit public policy.
In the late 1940s and early 1950s, these suburban homes (for example, in places like Levittown outside New York City, Lakewood outside Los Angeles, and hundreds of other communities in between) typically sold for about $125,000 (in today’s dollars) and were easily affordable to working class families. With GI-Bill mortgages (no down payment required), suburban home monthly carrying charges were often less than rent that white families had previously paid in overcrowded urban apartments, the kinds of places where black families had to remain.
Today, these same Levittown or Lakewood homes sell for $500,000 or more. The white families who settled in these places gained, over the next few generations, some $400,000 in equity appreciation. Black families, denied this opportunity by de jure segregation policy, realized no such gains. African-American median family income today is about sixty percent of white median family income, but African-American median household wealth is only five percent of white median household wealth (including home equity). Families that gain home equity appreciation over several generations have many opportunities to convert that equity into more liquid wealth that can be used, for example, to pay for children’s (or grandchildren’s) college, or perhaps to support parents in retirement, relieving children of the financial pressure to do so. For white and black families with similar middle class incomes in 2007, the wealth of black families not attributable to present home equity was only twenty-two percent of that of white families. 
Differences in family wealth thus have enduring effects on college attendance. These differences today are, to a great extent, vestiges of explicit twentieth-century federal segregation policy that violated the Fifth and Thirteenth Amendments to the Constitution. College admissions officers, ostrich-like, can favor students of all races and ethnicities whose families have little wealth for whatever reason. Such favoritism, however, is an inefficient means of remedying de jure segregation: it will round up many non-black students from low-wealth families. That is a worthy social policy goal, but is no substitute for remedying a history of state-sponsored racial injustice.

James Bond Law

Ernst Stavro Blofeld, nejslavnější padouch a protivník Jamese Bonda, a stejně tak i jeho zločinecká organizace SPECTRE, chybí ve světě agenta 007 už více než 40 let. O autorská práva k této části bondovského světa se totiž od šedesátých let soudili tvůrce Bonda Ian Fleming a jeho spolupracovník/scénárista Kevin McClory. Nakonec z toho byl nekonečný spor, který pravidelně ústil v dlouhé soudní tahanice ve Velké Británii a USA.

Spory se nicméně po padesáti letech podařilo urovnat v roce 2013, čehož výsledkem je blížící se film SPECTRE s Danielem Craigem, ve kterém hlavní roli hraje zločinecká organizace stejného jména a ústředního padoucha ztvárnil charizmatický Christopher Waltz. Proč je ale u Waltzovy role uvedeno “Franz Oberhauser” a ne Blofeld?

Up until now, Warner Chappell Music, a division of the Warner Music Group, has charged people for use of the song. It acquired the copyright—originally filed by the Clayton F Summy Co in 1935 —in 1988, according to the BBC. Until now it could not be sung on TV or radio, in films and other public performances without producers having to pay a fee."

  • Velké věci předvádí brazilský nejvyšší soud také v kauzách ohledně vězeňského systému: (Vanice Regina Lirio do Valle: An Unconstitutional State of Affairs in the Brazilian Prison System) "The failure of the prison system in Brazil is self-evident, and this matter has recently been brought before the Supreme Federal Court through several lawsuits, each treating different aspects of the State’s wrongful management of the issue. Evropská komise nenavrhla omezit strukturální fondy

Zastoupení Evropské komise v Praze tímto uvádí na pravou míru informace, které se dnes objevily v médiích o tom, že předseda Evropské komise Jean-Claude Juncker údajně navrhl omezit vyplácení prostředků ze strukturálních fondů těm členským zemím EU, jež odmítají návrh Evropské komise na rozdělování uprchlíků.

Předseda Evropské komise Jean-Claude Juncker toto nikdy nenavrhl, ani tak nezamýšlí učinit.

Takové opatření není možné ani právně, neboť Dohody o partnerství ani Operační programy pro současné období neobsahují právní základ, který by podobné opatření umožňoval provést.

Jinými slovy, není právně možné omezit evropské strukturální a investiční fondy v případě, že členský stát odmítá relokační mechanismus, navrhovaný Evropskou komisí.

Takové opatření by vyžadovalo změnu tzv. víceletého finančního rámce, a o tom Evropská komise v tuto chvíli neuvažuje.

Minulý týden se na soudní svět valily zajímavé zprávy o sporech mezi obchodními společnostmi a lidskoprávními požadavky.
  • Potenciálně velký případ: Supreme Court of Canada rules Ecuador villagers can go ahead with US$9.5-billion legal case against Chevron. "In Friday’s ruling, the court flatly rejected Chevron’s arguments. “[T]he approach favoured by Chevron is sound neither in law nor in policy,” Justice Gascon wrote." Na první pohled to vypadá pro Chevron bledě, ale je nutno zdůraznit, že se jednalo "pouze" o procesní spor, o meritu se bude teprve rozhodovat.
  • Zajímavá věc ze Španělska, kde už má protibyznysová mobilizace nějakou tradici: Dispute at Coke Bottling Plant Could Signal Labor Challenges for E.U.. "The dispute at this factory dates from January 2014, when Coca-Cola Iberian announced it would close four of its 11 Spanish factories, including Fuenlabrada. The company said the plants were operating at about half of production capacity. The original plan called for the company to lay off 1,190 of its nearly 4,600 workers in Spain. After street protests and strikes, the company said it would reduce the job cuts to 840 workers. Unions nonetheless took the company to court — and won. In June 2014, Spain’s national court found that the company had not adequately informed workers of its layoff plans and had illegally circumvented their right to strike by using alternative production and distribution channels. The company appealed to the Spanish Supreme Court, losing again. In April, the Supreme Court ordered Coca-Cola Iberian to rehire any employee who did not accept the company’s layoff package, worth an average 135,000 euros per dismissed worker, according to the Spanish bottler. About 300 workers, including the 220 holdouts in Fuenlabrada, are now hoping that the lower Spanish national court will grant them the right not only to resume work, but also to return to the same jobs that they previously held — namely, bottling Coke and the company’s other beverages. Legal experts said that it would be unprecedented for a court to force a company to produce a specific product against its will. But the Coca-Cola brand name is being “used as a symbol” by disgruntled workers as part of their broader fight against multinational capitalism, according to Román Gil Alburquerque, another partner at the Sagardoy law firm."

Čekání na první český kyberútok

S nedávnou výměnou na postu ředitele Úřadu pro ochranu osobních údajů se nabízí otázka: Kdy dojde k prvnímu velkému úniku osobních dat Čechů? Pokud totiž takový kyberútok právě neprobíhá, jistě se jej brzy dočkáme. První český “hack”, tedy velký a úspěšný kyberútok na český cíl.

O obřích kyberútocích na firmy a veřejné instituce v USA i západní Evropě se píše každý měsíc, jen v ČR stále nic. Bude to pojišťovna, internetový obchod nebo automobilka? A nebo hackeři získají všechna daňová přiznání Čechů? Nelze čekat, že se Česku vlna hackerských úspěchů vyhne.

  • The Economist se ptá: Is it bad to have a bunch of old judges? Ginsburgové je 82, Scaliovi a Kennedymu 79, Breyerovi 77 - je to problém?
  • Parádní případ! E. Volokh: Federal government’s allowing Big Mountain Jesus statue on federal land in Montana doesn’t violate the Establishment Clause. ("First, USFS’s decision to renew the statue’s permit reflected a primarily secular purpose. The government identified secular rationales for its continued authorization including the statue’s cultural and historical significance for veterans, Montanans, and tourists; the statue’s inclusion in the National Register of Historic Places; and the government’s intent to preserve the site “as a historic part of the resort.” (..) Although the dissent focuses on the monument’s appearance, that the statue is of a religious figure, and that some of the initial impetus for the statue’s placement was religiously motivated, does not end the matter. (..) (“[T]he Establishment Clause does not compel the government to purge from the public sphere all that in any way partakes of the religious.”").  A tahle slova by se v evropských rozsudcích taky asi jen tak neobjevují: "the flippant interactions of locals and tourists with the statue suggest secular perceptions and uses: decorating it in mardi gras beads, adorning it in ski gear, taking pictures with it, high-fiving it as they ski by, and posing in Facebook pictures".
  • Zajímavá věc z Nizozemska: "A court in the Netherlands ruled on Wednesday that a natural gas company, a joint venture by Royal Dutch Shell and Exxon Mobil, must compensate homeowners for declines in the value of their properties because of earthquakes linked to production at the Groningen field. The ruling by the court in Assen could result in billions of euros of claims against the venture, known as NAM. Hundreds of thousands of homes and buildings lie in the affected area, which covers wide parts of the northern Netherlands. (..) The court ruling specified that homeowners need not show that their property had suffered any physical damage, only that its value had been affected by its location in the quake area. It also found that homeowners could request compensation immediately, rather than waiting for a sale."
  • Jeffrey Toobin si myslí, že liberálům u Nejvyššího soudu USA už dobře bylo. V poslední době vyhráli velké bitvy (gayové, Obamacare), jenže konzervativci možná vyhrají ty nadcházející (affirmative action, potraty, odbory).

  • A zajímavá sportovní kauza z tuzemska: Nejvyšší soud potvrdil trest hokejistovi, který zlomil zuby protihráči ("V roce 2007 Nejvyšší soud průlomově rozhodl, že za hrubý faul a zranění protihráče mohou sportovci v Česku čelit trestnímu stíhání pro ublížení na zdraví a dostat se před soud. Některé závažnější případy totiž nelze řešit jen prostřednictvím pravidel a disciplinárních řízení jednotlivých sportovních svazů. Tehdejší rozhodnutí se týkalo skluzu při fotbale, který způsobil zlomeninu. Nedávno NS řešil také občanskoprávní odpovědnost za škodu způsobenou tvrdým zákrokem při fotbale. Hejna autonomních dronů

Spousty autonomních dronů operujících v "hejnech" (swarm) jsou jedním z budoucích využití levných a chytrých dronů. Prozatím koncept tzv. systému systémů, kdy drony tvoří jakýsi předvoj skutečného útoku. Asi něco jako dříve střely s MIRV hlavicemi... Pro obranu celkem průser.

(Spain's campaigning judge seeks change in law to prosecute global corporations: "Now Baltasar Garzón, the Spanish judge who redefined the boundaries of cross-border justice, has set his sights on widening the definition of international law to target corporations that carry out economic or environmental crimes. “Humanitarian and economic crises cause more deaths around the world than all of the genocides we have documented,” said Garzón, who made headlines around the world when he ordered the 1998 arrest of former Chilean dictator Augusto Pinochet in London.")
  • Adam Liptak v NYT nešetřil soudce SCOTUS Clarence Thomase: "Justice Clarence Thomas has not asked a question from the Supreme Court bench since 2006. His majority opinions tend to be brisk, efficient and dutiful.   • V USA žijí právní blogy zajímavou otázkou, jestli odvolací soudcové (v tomto případě mj. respektovaný, byť kontroverzní soudce Posner) mají v adversárním procesu spoléhat pouze na argumentaci stran, nebo si mohou udělat i vlastní internetový výzkum. Profesor Eric Segall se například staví za Posnera: "The availability of an enormous amount of reliable internet information is a phenomenon less than fifteen years old. How judges should use that vast repository is a difficult question that requires more study and thought. But, in this case, where the issue was one of correct medical procedure, where that question can be looked at through examination of numerous respected web sites, and where the adversary process involves a resource-deprived prisoner against a well-funded state defendant, it would be the height of formalism to prohibit appellate judges from consulting any source outside the formal and closed record of the case. Kdo vyhrává investiční arbitráže

Když má zahraniční podnikatel pocit, že ho podrazil stát, ve kterém se rozhodl investovat, často nemá mnoho příležitostí k obraně. Někdy dokonce jen jednu – mezinárodní arbitráž. Z dosavadních dat se zdálo, že i před arbitry tahá investor za kratší konec provazu. Novější čísla ale mluví jinak.

Zahraniční investoři obecně státy nežalují nijak rádi. Často to totiž znamená konec jejich místního byznysu. Na druhé straně jde mnohdy o jedinou možnost, jak se svých práv domoci – navíc leckdy byznys po zásahu státu beztak končí. Jsou státy, které bez náhrady znárodňují zahraniční podniky nebo protiprávně ruší investorům licence na těžbu nerostů. Jindy jsou politici rafinovanější a elegantně se pohybují na hraně legality, když například omezují volnost podnikání nebo zavádějí mimořádné daně. Ostatně to je i příklad českých solárních arbitráží.

O kamarádíčkování v českých odborných časopisech

Před nedávnem nám s Jakubem Fučíkem vyšel v časopise Obrana a strategie článek s názvem "Noví aktéři na poli válečných konfliktů. Případová studie Nejvyššího soudu Izraele". Po nějaké době jsem si zase napsal něco jen tak z radosti, navíc na téma, které převážně nedělám, takže to celé mělo i samovzdělávací přínos. Dnešní zamyšlení věnuji pocitům krátce po publikování textu - funguje to tu docela dobře. Jedná se samozřejmě o naprostou anekdotu a jiní mohou mít zcela jiné zkušenosti (a nedělám si iluze, asi i mají), nicméně z mého pohledu funguje tuzemská politologická časopisecká scéna velmi slušně. 
Důležitým člověkem v Obraně a strategii je Pepa Kraus (tajemník redakční rady), s nímž jsem strávil asi 15 tisíc kilometrů v autě při cestě z Washingtonu k Niagarským vodopádům na kanadské hranice, napříč USA do LA a zase zpátky na východ. Dalších cca 5 tisíc kilometrů přibylo při cestování po Neapoli, sicilských mafiánských vesničkách a podobně laděných kalábrijských skvostech. Pan tajemník nás s pomocí busů a šílených i příjemných řidičů provázel po Íránu a taky jsme absolvovali docela speciální roadtrip (půjčeným autem) Brno - Sulaymaniyah (kurdská část Iráku) (u všech těchto cest byl i Tom Šmíd). Dalo by se tedy říci, že se jedná o osobu docela blízkou. Nicméně v publikační praxi zavládly vztahy zcela profesionální. První posudek z OaS vyzněl výborně, druhý již byl kritičtější, tudíž následovalo oblíbené "revise and resubmit". Nutno říci, že výtky z posudku spadaly do kategorie racionální a akceptovatelné, tudíž jsme článek předělali a napodruhé to již vyšlo, byť po dalších kritických připomínkách a dílčích předělávkách. Recenzní proces probíhal zcela férově, zejména kritický posudek byl kvalitní, znalý problematiky a s poznámkami k věci. Kamarádství šlo zcela stranou. 
Kdysi jsem spolu s Helenou Bončkovou publikoval článek k výjimkám z Listiny základních práv EU v časopisu Současná Evropa, opět, recenzní řízení bylo solidní, dva posudky, docela k věci. Podobné zkušenosti mám se SEPSem (článek k mezinárodním lidskoprávním smlouvám), a to jej nechválím jen proto, že mu šéfuje Pavel DufekPolitologický časopis pod vedením Petra Kanioka a Vlasty Havlíka funguje zcela bez pochyb, tam by nějaká skrčka asi nevyšla. 
Specifické jsou Mezinárodní vztahy (článek k EU a LP), kde se dělají klasické dva posudky, ale šéfredaktor Vít Beneš v zásadě působí jako třetí recenzent, a to ještě mnohem tvrdší než dva experti na dané téma. V MV to tedy vypadá zhruba jako v NQHR, kde jsme spolu s Katarínou Šipulovou vydali článek k případu D.H. a síle mezinárodních soudů, který prošel hned u tří dosti náročných a místy detailistických recenzentů. 
Co jsem tím vším chtěl říci? Mé osobní zkušenosti s českou časopiseckou scénou jsou výrazně pozitivní, šéfredaktoři dělají, co mají a svou práci vykonávají poctivě, recenzenti jakbysmet. Navzdory kamarádství s drtivou většinou jmenovaných jsem zatím nějaké úlevy nepocítil. Jen doufám, že podobné pocity mají i ostatní členové tuzemské komunity.

Dnes nejen o rozsudcích, ale také o soudech, soudcích a ústavách v širších souvislostech.

  • New Hampshire federal court: Prohibition against distributing ballot photos is unconstitutional: "the “secret ballot.” It’s not constitutionally mandated — at least, not in the federal constitution, though in some states it is expressly required — and I was surprised to learn that it only came into widespread use in this country in the late 1800s (..). federal district court in New Hampshire, invalidating a New Hampshire statute that prohibited “taking a digital image or photograph of his or her marked ballot and distributing or sharing the image via social media or by any other means … with the intention of letting it be known how he or she is about to vote or how he or she has voted." (..) the statute could not survive the “strict scutiny” required by the First Amendment for “content-based” prohibitions of this kind."
  • Zajímavá úvaha Benjamina Perrymana na téma mazání digitální stopy po kandidátech na nejvyšší soudcovské posty: "(..) efforts have been made to modify the digital footprint of Canada’s newest Supreme Court of Canada appointee, Justice Russell Brown, who was a prolific blogger when he was a law professor at the University of Alberta. An intense debate ensued on the propriety of appointing a judge with such publicly held and provocative views. But the real problem is not the prior public posts of a judicial appointee, but rather that we lack clear and transparent rules for when a judicial appointee’s digital footprint can be deleted with integrity. In the absence of such rules, efforts to modify a judicial appointee’s digital footprint risk harming public confidence in the judiciary."
  • Edward Rubin: Incoherence of Court’s dissenters in same-sex marriage ruling - nic moc nového se tu nedočtete, ale na druhou stranu se jedná o svižný kousavý pohled na disentéry a jejich výtvory v Obergefell: "It’s not their position, their basic arguments, or even the intellectual weakness of those arguments (there is, after all, no principled basis for opposing government recognition of same-sex marriage). It’s the incoherence, insensitivity, and generally hysterical quality of those opinions that provide the drama in this important but widely-predicted decision."
  • Krátké shrnutí politologického bádání o tranzitivní spravedlnosti a něco nového k tomu: Wendy Wong: Opting for Trials Post-Conflict? Why the Structure of Losers Matters. "trials are not simply an internationally imposed outcome, but a political choice taken in light of various pressures from external actors, to be sure, but also internal considerations. Some of our research addresses the question of under what conditions post-conflict should we expect “the winning party” (i.e. now, the government) to try “the losers” (i.e. their former opponents)? (..) what really matters is how the losers were structured. Centralized oppositions can mount more effective resistance both in terms of lethality, but also in terms of giving and receiving orders; centralized commands have a higher expectation that their strategies will be followed all the way down the chain. (..) winners are more likely to use trials against centralized losers, that is, losers that were more vertically-organized during the conflict, because of their organizational structure. This runs counter some of the findings in the transitional justice literature."
  • Nové poznatky o vztahu mezi ústavodárným procesem a kvalitou demokracie - rozhoduje úvodní fáze! Crafting a new constitution doesn’t necessarily lead to democracy. Here’s what does (Eisenstadt et al.): "Does writing a constitution lead to democracy? Sometimes—but not always. Post-Arab Spring, citizens of Egypt and Morocco ended up with “hybrid” regimes that mix some features of democracy with authoritarianism, as has been happening around the world. But in neighboring Tunisia, the new constitution did usher in profound democratic change. (..) we studied 138 countries that had adopted new constitutions between 1974 and 2011. Three years after those constitutions were in place, 62 countries were more democratic—but 70 others were either less so or no better than before. In getting to democracy, we found, how the new constitution is crafted is as (or more) important as the language in its text. (..) level and depth of popular participation consistently makes the difference in whether that country ends up a democracy. (..) Democracy grows most fully, we found, when many different kinds of people help in the first phase: drafting a constitution. Bringing everyone in—from the business elites to the pushcart vendors, from conservatives to liberals, from constitutional lawyers to illiterates—while actually writing something is critical."

Obama rates well on none of these.

Now, however, the consequences of that foreign policy are becoming more obvious. The rebalance from the periphery to the core that Rose celebrates as an act of prudence has created power vacuums that have been filled by the likes of the self-declared Islamic State, or ISIS. The sense that Obama’s redlines are all negotiable, that his talk of all options being on the table is pure bluster, has led the country’s foes to believe that they can do as they please. And his faithlessness toward traditional friends has raised unsettling questions about the value of being a U.S. ally (just ask former Egyptian President Hosni Mubarak) and caused some to wonder whether they shouldn’t seek other patrons and otherwise do what they must to protect their interests, regardless of Washington’s wishes.
